DOOYA PRIVACY POLICY
DOOYA MEDIA GROUP INC. ("DOOYA, “we,” “us”) owns and operates the DOOYA video search and discovery application, DOOYA.TV, and other DOOYA media offerings. The following Privacy Policy (or “Policy”) explains how we may use and share data collected from and Mobile Application and web visitors, users and members’ confidential information and/or personal information (collectively “PI”). PI includes such information as, if requested or required, your full name, age, e-mail address, postal mailing address, telephone number, credit card number and related information, and/ or other information that may identify you. Where DOOYA requests or requires any or the entire PI during registration, that information may be known as “Registration PI”. A “User,” “Member” or “Visitor” is defined as a Registered User, Member or Visitor from general public to the Website and Mobile Application. This Privacy Policy applies to any and all features and services offered DOOYA on our Website and Mobile Application, any application mobile application developed by DOOYA and/or a third-party application developer service and other features (including embedded video players, and music, picture, text and/or other related editing software), and any other Website and Mobile Application features, content, or applications offered either now, or in the future by DOOYA related to the Website and Mobile Applications. PLEASE NOTE THAT THE ONLY THE LAWS OF THE UNITED STATES OF AMERICA AND CALIFORNIA APPLY AND SHALL GOVERN THIS DOCUMENT AND ALL OTHER LEGAL DOCUMENTS RELATED TO THE WEBSITE AND ANY MOBILE APPLICATION, REGARDLESS OF THE VISITOR’S REGION OR ORIGIN.
I. GENERAL USE
DOOYA is the sole owner of the non-PI information collected on DOOYA Applications, Websites, Services and Platforms, unless specifically stated otherwise. However, DOOYA will not sell, share, or rent this information to any third party other than as disclosed in this Privacy Policy. DOOYA may obtain PI and non-PI from Visitors at various different points on the Mobile, TV, Website and other Applications, depending on the service or feature you access. Members may be required to provide the following, including, but not limited to, names, ages, email addresses, mailing addresses, phone numbers, fax numbers, credit card information and other PI and non-PI in order to access a particular section of the website, and/or to purchase goods and services on the Website or any Mobile Application. Members/Registered Users of the Site must create a user name and password, and are responsible for the protection of such information. You must contact DOOYA immediately should any unauthorized person gain access to any PI or other information, including user name and password. DOOYA IS NOT RESPONSIBLE FOR ANY UNAUTHORIZED ACCESS TO ANY VISITORS ACCOUNT ON EITHER THE WEBSITE OR MOBILE APPLICATION, AND YOU AGREE TO WAIVE RIGHTS AND RELEASE DOOYA MEDIA GROUP INC. FROM ALL LIABILITY FOR SUCH UNAUTHORIZED ACCESS, WHETHER SUCH INFORMATION ACCESSED IS PI OR NON-PI.
DOOYA may amend or change the terms of this Privacy Policy at any time without notice whether such changes are made in adherence to changes in any laws, regulations or internal policy and practices established by DOOYA. Any and all such modifications shall be immediately effective upon posting on the Website and Mobile Application. All Users/Members/Visitors agree that any continued use and access to the Website and Mobile Application, and or our services after DOOYA posts a revised Privacy Policy will act as your acceptance of the revised Privacy Policy. You are therefore responsible to read and understand the Privacy Policy, and any changes or modifications. If we materially change any practice related to the collection or use of your PI, the Privacy Policy that governs your PI will be the Policy under which any information was collected. You must provide DOOYA any objection to any change in the Policy immediately upon review of the policy, otherwise you automatically agree to those changes.
II. CHILDREN’S ONLINE PRIVACY PROTECTION ACT (“COPPA”)
Our Website and Mobile Application has been developed for use and enjoyment by a general audience, including children under the age of thirteen (13). As such DOOYA recognizes the privacy interests of children, and the concerns parents have for the privacy and safety of children on the Internet. DOOYA therefore strongly encourages parents and guardians, and or other adults, to take an active role in children's Internet activities and interests. DOOYA does not intentionally or knowingly collect information from any Visitor under the age of thirteen (13). For avoidance of doubt, DOOYA is in full compliance with the Children’s Online Privacy Protection Act (“COPPA”), and all other laws, rules, regulations and policies affecting children’s’ online privacy and safety.
YOU HEREBY AGREE THAT YOU HAVE READ AND UNDERSTAND AND AGREE TO THE PROVISIONS OF COPPA AND THE DOOYA PRIVACY POLICY, AND YOU FURTHER AGREE AND STATE THAT ANY AND ALL PARTICIPATION ON THE WEBSITE AND MOBILE APPLICATION HAS BEEN AUTHORIZED BY YOU, AND/OR YOUR PARENT OR LEGAL GUARDIAN. YOU FURTHER AGREE TO HOLD DOOYA HARMLESS FOR ANY MISLEADING OR FRAUDULENT, DEFAMATORY OR OTHERWISE TORTIOUS ACT COMMITTED BY YOU OR YOUR CHILD OR WARD AS A VISITOR OR REGISTERED MEMBER TO THE SITE FOR VIOLATION THIS SECTION OF THE PRIVACY POLICY, AND ANY SECTION OF THE PRIVACY POLICY WHATSOEVER. FAILURE TO MONITOR YOUR CHILD OR WARD ’S (whether or not you are legal guardian) ACTIVITIES PROPERLY MAY SUBJECT YOU TO APPROPRIATE REMEMEDIES AS AFFORDED BY LAW
III. INFORMATION DISCLOSURE AND SHARING
A. INTRODUCTION
DOOYA collects PI from any User/Member/Visitor as part of the registration process to become a Member of DOOYA. DOOYA may also collect PI from you if you choose to participate in other features or Website and Mobile Application services, including as applicable, blogging, receiving or sending texts, videos, e-mails or e-mails outside or within the Website and Mobile Application, newsletters, content submissions (“Visitor/User Content Submissions”) or any other information, or in connection with content or suggestions you submit to DOOYA for review.
B. DOOYA may share PI in the follow instances:
DOOYA may provide PI to trusted partners who work on behalf of or with DOOYA under confidentiality agreements, including but not limited to, partners to facilitate the transfer and use of information to enable the Applications, Website and other DOOYA services to work properly. These companies may use your PI to help DOOYA communicate with you about changes to the Website or Mobile Application, certain offers from DOOYA and our marketing partners. However, these third-party partners do not have any independent right to share this information.
Additionally, DOOYA has a parent's permission to share the information if the user is a child under age 13. Please see the Section on COPPA within this Agreement. DOOYA may need to respond to subpoenas, court orders, or legal process, or to establish or exercise our legal rights or defend against legal claims. DOOYA’ policy is to share information in order to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, violations of DOOYA's terms of use, and/or as other circumstances required by law.
You grant DOOYA the right to transfer information about you if DOOYA is acquired by or merged with another company. DOOYA will notify you before information about you is transferred and becomes subject to a different privacy policy should it become necessary. Any error or omission to notify you of such transfer shall not be deemed a breach of this Privacy Policy. DOOYA reserves the right to display targeted advertisements based on certain PI. If you click on certain advertising, DOOYA and its partners (including ad serving companies) may assume that people who interact with, view, or click targeted ads meet the targeting criteria—for example, men ages 25-39 from a particular geographic area.
DOOYA does not provide any personal information to the advertiser when you interact with or view a targeted ad. However, by interacting with or viewing an ad you are consenting to the possibility that the advertiser will make the assumption that you meet the targeting criteria used to display the ad.
DOOYA advertisers may include financial service providers (by way of example, banks, financial institutions, insurance companies, stock brokers and mortgage lenders) and non-financial companies (such as retail establishments, travel, and technology companies). DOOYA works with business partners, vendors, advertisers, and other service providers in different industries and categories of business to keep costs low for use of the Mobile, Website and other Applications. C. TERMS AND CONDITIONS OF SERVICES INCORPORATED HEREIN
DOOYA incorporated by reference the Terms and Conditions of Service of the Mobile, Website and other Applications. DOOYA reserves the right to disclose PI or non-PI submitted by or related to any Visitor as required by any law, rules, regulations, or in DOOYA’s absolute discretion. Additionally, and without limitation, we reserve the right to disclose PI or non-PI when any User, Member or Visitor violates the Terms of Service or any other agreement with us, or engages (or is suspected of engaging) in any harmful (including defamatory or “cyberstalking” behavior), infringing or illegal activity; any threatening or abusive behavior or in any unauthorized access or infiltration, or any attempted access or infiltration of the Website or Mobile Application, including but not limited to, to any and all law enforcement agencies for investigative or prosecutorial purposes.
Visitors and Users of the Applications, Website or other Services further hereby agree that DOOYA may disclose any PI, with or without a subpoena, warrant, or other court order. Furthermore, you agree that DOOYA may be required to disclose any PI in response to court, regulatory or administrative proceedings, orders, civil subpoenas, discovery requests, litigation or as otherwise required by law. DOOYA may also provide PI or non-PI in response to allegations of intellectual property infringement of any other person, entity, or DOOYA, or in our absolute discretion. We also reserve the right to suspend and/or terminate your Membership related to any suspected or alleged, illegal, infringing, or inappropriate activity, or in violation of our Terms of Service.
Users, Members and Visitors agree to allow DOOYA to use PI or non-PI: (a) to alter or modify services and feature of the Applications , Website and/or other Services; (b) to determine which advertisements or sponsor messages, if any will be served to your browser, pursuant to the Terms and Conditions of Service and the Privacy Policy; (c) to send you announcements, updates, and if applicable, other third party materials that we feel may be of interest to you; and (d) in our absolute discretion to uphold and maintain the mission of DOOYA. Provided, however, Users/Members/Visitors may "opt out" of receiving these materials, as set forth below.
D. DISCLOSURE NON-PI
In addition, DOOYA may request other non-PI, including IP addresses, user data, and browser type. This data is used to manage and improve our Applications, Websites and Services, create and maintain a dynamic and exciting user experience, track usage and interest, and for security purposes.
Members may also choose to provide or store non-PI information in their profiles, including but not limited to your age, general interests, hobbies, groups, affiliations, text, videos, music, pictures, internal e-mails whether or not original to Members, Users and Visitors. Any Member Profile is created at your discretion, provided, however, that DOOYA retains the right and authorization in its sole discretion to terminate your Profile at any time for any reason without notice.
Registers Users may change their Registration PI and identifying information at any time and may control how Users/Members/Visitors and DOOYA communicate with them by maintaining control over account settings, which is accessible within the “Edit Profile” frame of the Member Profile. Provided, however, you agree to be responsible wholly for any changes, maintenance and protection of your profile data and PI.
E. USE OF TRACKING INFORMATION/COOKIES
“Cookies” are small pieces of information that DOOYA sends to your computer. We use cookies to identify your Internet browsing capabilities, store certain preferences, determine whether Users/Members/Visitors have installed software needed to access certain content on the Website and Mobile Application, participate in the services, and to ensure validity of data inputted by you. Data in cookies may be read to authenticate user sessions or provide services.
Pursuant to the provisions which deal with use of PI and non-PI by business partners, like advertisers, any current or future display of third party advertisements on the DOOYA Applications, Website or Services may also contain cookies set by those Internet third-party advertising companies or advertisers (known as “third party cookies”). DOOYA has no control whatsoever over these third party cookies and Visitors should check the privacy policies of any other website or company that may use cookies via the Internet to determine whether and how any other third parties use cookies or other tracking technology.
If you are concerned about use of cookies or other tracking technology, you may use the third-party programs or applications on your computer to obtain notices from those programs and/or applications of the use of any such information.
F. DISCLOSURE OF MEMBERS’ AND VISITORS’ NON-PI
You understand and agree that your choice of a unique user name or one which may be provided to you at the time of registration to the Application, Website or Services shall be deemed non-PI. You agree that user names that may be published on the Application, Website may be disclosed to third parties, including, but not limited to, to the public, other Users/Visitors/Members and to any third parties with whom we may provide such information, and for purposes of creating a social network, if necessary. Additionally, you agree, acknowledge and understand that any or all PI or non-PI (including, but not limited to, your name) you may publish, provide, or submit in any public area of the Application, Website or in any content or material submitted, transmitted or posted by Users/Members/Visitors (including, but not limited to blogs, Registered Member Profiles, comments, content, submissions, texts, e-mails or message boards), such information will become public information and will be published on the Website and Mobile Application. Such PI or non-PI will be disclosed to other Users/Members/Visitors to the Application or Website and to other third parties who may have authorized or unauthorized access to or otherwise see a display of such information, provided, however, such non-PI shall be limited to those portions of the Application/Website/Services that allow for disclosure of such PI.
You and your heirs, licensees and assignees, hereby release, waive any claims against, and hold harmless DOOYA MEDIA GROUP INC., its related or affiliated entities, partners, parent, members, subsidiaries, affiliates, sponsors, officers, directors, shareholders, representatives, agents, contractors, consultants, employees, from and against any and all claims and allegations whatsoever relating to any and all disclosure, sharing, or publication of both non-PI and PI.
G. DOOYA’ PROTECTION OF PI
DOOYA shall endeavor to maintain all reasonable, standard and commercially available technical and other measures to safeguard against loss, theft, unauthorized use, disclosure or modification of any PI and financial information provided to us. Users, Members and Visitors agree, however, to regularly check PI and non-PI to protect against any unauthorized use of such PI and financial information. DOOYA agrees to periodically amend and review our security policies and procedures to protect such PI. Any User, Visitor or Member is ultimately responsible for the security of PI, including any user name and password. H. CHANGES TO PI
As DOOYA Users/Members/Visitors, you should regularly and periodically review any PI you provide us on any Platform or through any Service, for accurate and current record-keeping, and to minimize mistakes or problems. DOOYA will take reasonable steps to correct and/or update any PI so long as we receive adequate notice and correct information from you. Any Registered User/Member can view and change registration information, PI, or other preferences, and Profile Information by logging into your account and accessing features such as “Edit Profile” and “Account Settings.”
DOOYA will honor all requests to discontinue use of any PI or non-PI, provided, however, Users/Members/Visitors agree that DOOYA may retain any record of your PI that is necessary to comply with applicable federal, state or local law, rules or regulations.
